Murphy Congratulates Tyrrelstown Resident On Victory Over Management Co

Catherine Murphy, TD (Ind) has today congratulated a resident of Tyrrelstown, Dublin 15 on his victory in the Circuit Court over the Management Company to whom he refused to pay annual maintenance fees. The resident, who took the case to the Circuit Court on appeal, refused to pay fees to the company whom he claimed failed to provide the services for which they were charging. Murphy, herself dealing with several residents groups caught in what she has termed the "management company trap", highlighted the importance of the victory not only for the applicant but for homeowners throughout the country.

"Everyday I get calls from residents groups and homeowners who are caught paying management fees to companies, but in many cases question what they are actually being charged for. We’re constantly being asked what will happen if they don’t pay the fees; how they can wind up the management company; or should they go to the AGM called by the Developer to place the burden of directorships of the management company on to residents. Today’s judgment is a stunning success for residents and for Deputy Joe Higgins who has been assisting the group." – Murphy

The North Kildare TD has however stressed the urgency with which she would like the Government to respond to this judgment from a policy and statutory standpoint.

"Yet again this government is failing to make hard decisions where policy and legislation is concerned. They’re only too happy to let the courts handle the issue of management companies because that way they don’t have to take on the building industry. We’ve got to see real leadership in Government on issues like this that have such an impact on the lives of ordinary people all over the country. I’m calling, yet again, for legislative provisions to be enacted that will regulate the operation of management companies for apartments and that will outlaw them for traditional housing estates. We simply must provide homeowners consumer protection on this issue because at this stage there’s more certainty involved where buying a toaster is concerned!"
