TD Calls For Government Action Plan To Tackle Unregulated Management Companies

Deputy Catherine Murphy (Ind) has today called on Government to inject a new urgency into its handling of what she has described as the "disgraceful practice of developers and Local Authorities off-loading their estate maintenance responsibilities on homeowners through the establishment of management companies." She highlighted that this problem requires a two pronged approach; one for those living in multi-unit buildings and another for those in house-only developments.
Estate Management Companies should not exist in house-only developments, according to Murphy. Minister for the Environment, Mr Dick Roche TD in October 2005 while acceding to this rationale in stating that the Planning & Development Act 2000 is not intended to be used by Local Authorities to "side-step their responsibilities or try to pass them on to residents", has proposed no legislative reform. Murphy has called for a definitive addition to the statute book that safeguards homeowners in house-only developments from having estate management companies thrust upon them. Furthermore she has called on all Local Authorities to prioritise the taking-in-charge of all house-only developments that are subject to management company charges as a matter of urgency. "Those people who’ve already been caught in this trap are literally paying for it each day action is delayed."
Multi-unit buildings, while in need of some form of management company system due to the sharing of common facilities such as stairwells, lifts, and the structure itself, must also be subject to legislative provision to secure the rights of owners. "We need a solid commitment from Government that this issue will be tackled strongly, sooner rather than later as those currently paying management fees or considering buying into such developments are in limbo. They have to pay the charges but have no guarantee’s as to where the money goes, and who spends it" – Murphy.
